Abstract

Translation norms for legislative language constitute an essential part of the normalization of legislation. Non-normative expression of legal provisions imperils the quality of legislation, which further impacts the development of legal education, judicial practice and law enforcement. So far, China has come to noticeable fruition in the normalization of legislative language, but more efforts are in urgent needs with regard to the systematization and institutionalization of linguistic norms. Furthermore, few efforts have been devoted to establishing norms for the translation of legislative texts. By investigating the status quo of translation norms for Chinese legislative language and comparatively examining the legislative technical specifications in other countries and regions, this paper puts forward feasible suggestions for systematic and institutional construction of translation norms for Chinese legislative language.

立法語言翻譯規範是立法語言規範化的重要方面。法律條文的語言表述規範與否直接決定了立法品質的高低，進而影響到普法教育、司法實踐以及執法活動的開展。而立法文本的翻譯是否規範關乎我國法治故事的國際傳播和法治形象的國際塑造。當前，我國在立法語言規範工作中取得了顯著成效，但在規範的體系化、制度化建設方面仍有待完善。就立法文本對外翻譯實踐而言，翻譯規範建設才剛剛起步。本文通過考察我國立法語言翻譯規範的現狀，在比較分析其他國家和地區的立法技術規範檔的基礎上，嘗試為我國立法語言翻譯規範的體系化、制度化建設提出可行的建議。
